日本では、コロナ感染予防の緊急事態において内閣に特別な権限を付与する規定を追加するために日本国憲法を改正すべきだとの意見がある。しかし、現憲法にそのような規定は必要ない。アメリカにおけるロックダウンの司法判断を紹介します。

全国の裁判所で行われている裁判は憲法の規定に基づき、誰でも法廷で傍聴できるが、傍聴席で自由にメモが取れるようになったのは平成になってからだ。それまでは許可が必要とされていた上、実際に認められることはまれだった。変わるきっかけは、米国人の弁護士が起こした訴訟だった。

重要な民事訴訟の記録を永久保存する制度が東京地裁でほとんど使われず、多くの著名訴訟の記録が廃棄されていた。裁判所が「国民共有の財産」をないがしろにしてきた格好で、有識者からは「歴史を作っているという自覚が欠けている」と批判が出ている。
